Welcome to Domia ("Domia", "we", "our", or "us").
These Terms of Service ("Terms") govern your access to and use of the Domia platform, website, software applications, services, and related technologies (collectively, the "Platform").
By creating an account, subscribing to any Domia service, or using the Platform, you agree to be legally bound by these Terms.
If you do not agree with these Terms, you must not use the Platform.
Domia is a software-as-a-service (SaaS) platform designed to assist accommodation providers, vacation rental operators, property managers, bed and breakfasts, guesthouses, and similar hospitality businesses with property management, booking management, direct reservations, guest communications, automation tools, and related services.
Domia acts solely as a technology provider.
Domia is not:
Any rental agreement, accommodation contract, reservation agreement, or transaction exists exclusively between the Host and the Guest.
Users must:
Domia may suspend or terminate accounts that contain false, misleading, or incomplete information.
Users are responsible for:
Domia shall not be liable for unauthorized access resulting from the User's failure to protect account credentials.
Access to certain Platform features requires a paid subscription.
Subscription plans, features, pricing, and limitations are described on the Domia website and may be updated from time to time.
Subscriptions are provided on an annual basis unless otherwise specified.
Users agree to pay all subscription fees when due.
Subscription fees are charged in advance and are non-refundable except as expressly provided under the Domia Refund Policy.
Failure to pay fees may result in suspension or termination of services.
New subscriptions are eligible for a full refund if requested within fourteen (14) calendar days from the original subscription date.
Refund requests submitted after the fourteen-day period are not eligible for a refund.
The refund guarantee applies only to the first purchase of a subscription plan.
Hosts are solely responsible for:
Hosts must ensure compliance with all applicable laws and regulations.
Domia acts solely as a software platform and is not responsible for the conduct of Guests.
Any damage, theft, loss, vandalism, personal injury, property destruction, excessive cleaning costs, or other claims arising from Guest stays shall be handled exclusively between the Host and the Guest.
Domia shall not be liable for:
All such matters remain the sole responsibility of the Host and Guest involved.
Certain Hosts may require Guests to provide security deposits.
Any deposit arrangement exists solely between the Host and the Guest.
Domia does not:
Any dispute concerning a security deposit must be resolved directly between the Host and the Guest.
Domia bears no responsibility or liability regarding security deposits.
Nothing in these Terms creates:
Domia acts exclusively as an independent technology provider.
Hosts and Guests contract directly with one another.
Hosts are solely responsible for:
Domia does not provide tax advice and does not guarantee compliance with any tax obligations.
Hosts agree not to use the Platform to evade, avoid, conceal, or otherwise unlawfully reduce tax obligations.
Any penalties, fines, audits, assessments, or legal consequences arising from tax non-compliance remain solely the responsibility of the Host.
Domia takes reasonable measures to maintain platform security.
However, Domia cannot guarantee that third parties will not attempt fraud, phishing, impersonation, scams, unauthorized access, or other malicious activities.
Users are responsible for:
Domia shall not be liable for losses arising from phishing attacks, fraudulent communications, or unauthorized third-party actions beyond its reasonable control.
Users shall not:
Domia may suspend or terminate accounts for violations.
All Domia software, branding, logos, content, designs, technology, and intellectual property remain the exclusive property of Domia.
Users receive a limited, non-exclusive, revocable license to use the Platform.
No ownership rights are transferred.
Domia strives to maintain uninterrupted service but does not guarantee:
Scheduled maintenance, updates, outages, and third-party service disruptions may occur.
Domia may integrate with third-party services including booking channels, payment providers, messaging providers, AI services, and other software platforms.
Domia is not responsible for:
To the maximum extent permitted by law, Domia shall not be liable for:
Domia's total aggregate liability shall not exceed the subscription fees paid by the User during the twelve (12) months preceding the event giving rise to the claim.
Users agree to indemnify, defend, and hold harmless Domia, its directors, officers, employees, contractors, and affiliates from any claims, damages, losses, liabilities, costs, or expenses arising from:
Domia may suspend or terminate accounts if:
Termination does not affect accrued rights or obligations.
Domia reserves the right to modify these Terms at any time.
Updated Terms become effective upon publication on the Platform.
Continued use constitutes acceptance of revised Terms.
These Terms shall be governed by and construed in accordance with the Europeans laws of Malta.
Any disputes shall be subject to the exclusive jurisdiction of the courts of Malta.
